Labour breaches its own election finance laws

The Electoral Commission has decided to warn the party rather than passing the complaint on to police for investigation and an electoral law specialist says the commission risks turning the Electoral Finance Act into a "toothless law" if it decides against referring future breaches to police.

Parties would be put on notice that any similar breaches would be referred to the police, unless they were considered inconsequential to the public interest.

Things can only go down hill from here . Now I am all for transparency when it comes to political donations but I should be free to donate as much or as less as I want to without having to get third party status. I wouldn't mind been listed as such after giving a certain amount of money to a political party. But nobody should have to apply for third party status .

That aside the Electoral Commission is one of those body that should remain above the daily grind of politics this is vital to our democracy . Yet thanks to the Electoral Finance Act this no longer possible. At some stage Electoral Commission is going to seek prosecute a political party and I have no doubt that there will be an uproar.

While I like the way the NZ political system is geared but I do think that this shows that the Attorney-General shouldn't be a sitting MP . The Act must be awfully close to violating the Bill of Rights.
